Beach Bills Feb 2026

 Rep. Ken Sweezey's Three Beach Bills

State Representative Kenneth P. Sweezey (R-Duxbury) has filed three bills in the Massachusetts Legislature aimed at restoring fair and equitable public access to Duxbury Beach. These bills directly address the years-long conflict between conservation management policies and the rights of residents and beachgoers.

All three bills were presented to the Joint Committee on Environment and Natural Resources on March 4, 2026. We urge you to contact your state representative and senator and ask them to support this legislation.

H.5139 — An Act Establishing a Review Process for Beach Management Guidelines

 

This bill establishes a formal review process for the guidelines used to manage recreational use of Massachusetts beaches in areas where piping plovers and terns nest. It creates accountability and oversight for management protocols that have increasingly restricted public access at Duxbury Beach, ensuring those guidelines are subject to regular, transparent review.

H.5140 — An Act Creating Parity Among Massachusetts Beaches

 This bill requires that conservation-based access restrictions be applied consistently and equitably across all Massachusetts beaches. Duxbury Beach currently faces far more restrictive closures than comparable beaches in the state — this bill would end that disparity and ensure no single beach bears a disproportionate burden. 

H.5141 — An Act Promoting Recreation on Massachusetts Beaches

  This bill affirms the right of Massachusetts residents to recreational access on public beaches and directs that beach management policies balance conservation goals with the public's right to use and enjoy them.

For years, Duxbury Beach Reservation, Inc. has dramatically increased restrictions on public beach access under the guise of piping plover and tern protection — far beyond what is required by law and far beyond restrictions applied at comparable beaches across the state. Families have been locked out of a beach they have enjoyed for generations.
These three bills would bring accountability, consistency, and balance back to beach management in Massachusetts. I urge you to support them.
